Different taxes are involved in a property transfer operation. 

When the transfer takes place between two private persons, generally a Property Transfer Tax is paid. The current tax rate is 10% on the price of the transaction up to the first million Euro, and 11% thereon.

In the case of a property transfer such as one made by a company or property developer, VAT is applied (10% or 21% in other cases). An important note: when you declare VAT, you also have to declare a 1.5% Transfer and stamp tax (Impuesto de Actos Jurídicos).

This Stamp tax is also applied on notarial deeds such as Declarations of new buildings, certain loans and mortgages, etc.
